Horwath HTL was engaged to provide expert advice and analysis for a resort development facing appeals in the Planning and Environment Court in North Queensland. The assignment focused on evaluating the project’s feasibility and compliance with operational and regulatory conditions, offering impartial insights to support the litigation process.

Our role began with an extensive review of the project’s complex regulatory history. This included analysing changes made to the resort’s scope and design to align with evolving zoning laws, environmental requirements, and planning regulations. Special attention was given to key contested conditions that were central to the appeal, such as maintaining operational integration and providing adequate facilities to meet industry benchmarks.

The analysis required a detailed understanding of local planning frameworks and community objections, which often centred on environmental sustainability, infrastructure capacity, and land-use compatibility. By combining local knowledge with global hospitality expertise, we assessed the implications of these contested conditions on the project’s financial and operational feasibility.

Our team participated in expert discussions with other specialists to ensure the evaluation adhered to the court’s rigorous standards. This included preparing evidence-based reports that assessed the development’s compliance with planning requirements, operational viability, and alignment with industry norms.

The final expert report provided an impartial assessment, balancing regulatory compliance with operational feasibility.
